These Terms & Conditions ("Terms") govern your access to and use of Lendaz ("Lendaz", "we", "us", or "our"), including our website at lendaz.app, our property search and listing services, and our WhatsApp and Facebook Messenger channels (together, the "Services").
By using the Services, creating an account, or listing a property, you agree to these Terms. If you do not agree, please do not use the Services. Our Privacy Policy forms part of these Terms.
1. What Lendaz Is — and Is Not
Lendaz is an online platform that connects people looking for property with landlords and agents who list it. We provide search, mapping, and messaging tools. We do not own, manage, inspect, or let the properties shown on the Services.
- We are not an estate agent and do not act as one on your behalf.
- We are not a party to any lease, tenancy agreement, deposit, or other arrangement you enter into with a landlord, agent, or tenant.
- Any agreement you reach is strictly between you and the other party. Negotiating, viewing, paying, and contracting are your responsibility.
- Listings are supplied by third parties. We do not guarantee that a property exists, is available, is accurately described, or that the person listing it has the right to let it.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Services. If you use the Services on behalf of a company, agency, or other organisation, you confirm you are authorised to bind it to these Terms.
3. Your Account
- You must provide accurate, current information when registering and keep it up to date.
- You are responsible for keeping your password confidential and for all activity under your account.
- You must tell us promptly if you suspect unauthorised use of your account.
- You may not create an account in someone else's name, or maintain multiple accounts to evade a suspension.
4. Listing a Property
If you list a property on Lendaz as a landlord, agent, or authorised representative, you confirm and agree that:
- You own the property or are authorised by the owner to advertise it for rent.
- The listing is accurate and current — including rent, location, size, condition, amenities, and availability.
- Photographs are of the actual property being advertised, and you hold the rights to use them.
- You will remove or update the listing promptly once the property is let or no longer available.
- You will not list the same property multiple times to gain prominence in search results.
- You will not advertise a property you cannot lawfully let, or one that is subject to a dispute preventing letting.
- You will not discriminate against enquirers on any unlawful ground.
- You will respond to genuine enquiries in good faith.
Listings may be reviewed, edited for formatting, declined, or removed at our discretion — in particular where we believe a listing is inaccurate, duplicated, expired, or fraudulent. Approval of a listing is not an endorsement or verification of it.
5. Searching & Making Enquiries
- Search results, map positions, price estimates, and recommendations are provided for convenience only and may be approximate or out of date.
- Map pins and suburb boundaries are indicative. Informal addressing means an exact location should always be confirmed directly with the landlord or agent.
- When you make an enquiry, we may share your name and contact details with the relevant landlord or agent so they can respond.
- You must use enquiries genuinely — not to spam, market to, or harvest contact details of other users.
6. Safety & Fraud
Never pay a deposit, "viewing fee", or rent before you have physically viewed the property and confirmed the person you are dealing with has the right to let it.
Lendaz will never ask you to send money to an individual's mobile money or bank account to secure a listing. Treat pressure to pay quickly, prices far below market, and refusal to allow a viewing as warning signs.
We do not verify the identity of every user, nor the ownership or condition of every property. You are responsible for satisfying yourself about who you are dealing with before parting with money or signing anything. If you encounter a suspected scam, please report it to us at hello@lendaz.app so we can investigate and remove the listing.
7. Fees & Payments
- Searching and enquiring on Lendaz is free for property seekers.
- Certain features for landlords and agents — such as promoted or premium listings — may carry a fee. Any fee will be shown to you clearly before you commit to it.
- Payments to Lendaz are processed by third-party providers, including Paynow. Their terms apply to the payment transaction, and we do not store your full payment card details.
- Fees paid to Lendaz are for platform features only. They are not rent, deposits, or payments to any landlord or agent, and they do not guarantee that a property will be let or found.
- Unless required by law or stated otherwise, fees paid for platform features are non-refundable once the feature has been delivered.
8. Prohibited Conduct
You agree not to:
- Post false, misleading, fraudulent, or fake listings, reviews, or enquiries.
- Impersonate any person or organisation, including Lendaz staff.
- Post content that is unlawful, defamatory, obscene, harassing, or discriminatory.
- Scrape, crawl, harvest, or bulk-copy listings, images, or user data from the Services.
- Use the Services to send unsolicited marketing to other users.
- Attempt to gain unauthorised access to the Services, other accounts, or our systems, or interfere with their normal operation.
- Introduce malware, or use bots or automated means to interact with the Services without our written permission.
- Use the Services for any unlawful purpose, including money laundering or evading sanctions.
9. Your Content & Licence to Us
You retain ownership of the listings, photographs, descriptions, and other content you submit ("Your Content"). By submitting it, you grant Lendaz a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt for display, and publish Your Content for the purpose of operating and promoting the Services. This licence ends when you remove Your Content, except for copies retained in backups or where we must keep them for legal reasons.
You are solely responsible for Your Content and confirm you have the rights necessary to grant this licence.
10. Our Intellectual Property
The Lendaz name, logo, design, software, database, and all other materials on the Services are owned by Lendaz or our licensors and are protected by intellectual property law. You may use the Services for their intended purpose only. You may not copy, modify, reverse-engineer, resell, or create derivative works from any part of the Services without our written permission.
11. WhatsApp & Facebook Messenger
You may use the Services through WhatsApp and Facebook Messenger. When you do, your use is also governed by Meta's own terms. Automated replies and search results delivered through these channels are subject to the same disclaimers as the rest of the Services. You can stop receiving messages at any time by telling us to stop or blocking the number or page. See our Privacy Policy for how we handle messaging data.
12. Third-Party Services & Links
The Services rely on and link to third parties — including mapping providers, analytics, AI providers that power search, messaging platforms, and payment processors. We are not responsible for the content, accuracy, availability, or practices of third-party services, and linking to them is not an endorsement.
13. Availability of the Services
We aim to keep the Services available and working well, but we provide them on an "as available" basis. We may change, suspend, or discontinue any part of the Services — including features, listings, and pricing — at any time, with or without notice. Connectivity, data costs, and device limitations may affect your experience.
14. Suspension & Termination
We may suspend or terminate your account or remove your content, without notice, if we reasonably believe you have breached these Terms, posted fraudulent listings, or created risk or legal exposure for Lendaz or other users. You may close your account at any time by contacting us. Sections that by their nature should survive termination — including sections 9, 10, 15, 16, 17, and 18 — will do so.
15. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that:
- Listings, prices, locations, or availability are accurate, complete, or current;
- Any landlord, agent, tenant, or other user is who they claim to be, or will act honestly;
- You will find a property, or that a landlord will find a tenant;
- The Services will be uninterrupted, secure, or free of errors.
16. Limitation of Liability
To the fullest extent permitted by law, Lendaz, its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profits, income, data, or goodwill, arising from or connected to your use of the Services.
In particular, we are not liable for any loss arising from your dealings with another user — including money paid to a landlord, agent, or supposed representative, deposits lost, misrepresented properties, or disputes under a tenancy.
Where liability cannot lawfully be excluded, our total aggregate liability to you is limited to the greater of the fees you paid to Lendaz in the twelve months before the claim, or US$50.
Nothing in these Terms excludes liability for fraud or for anything that cannot lawfully be excluded.
17. Indemnity
You agree to indemnify and hold Lendaz harmless against claims, damages, losses, and reasonable legal costs arising from your breach of these Terms, your content, or your dealings with other users.
18. Governing Law & Disputes
These Terms are governed by the laws of the Republic of Zimbabwe. Any dispute arising from them or from your use of the Services is subject to the exclusive jurisdiction of the courts of Zimbabwe. We encourage you to contact us first — most issues can be resolved informally.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Significant changes will be communicated through the Services. Continuing to use the Services after a change takes effect means you accept the updated Terms.
